{"id":1091,"date":"2017-12-06T09:00:22","date_gmt":"2017-12-06T02:00:22","guid":{"rendered":"http:\/\/sewakantorsurabaya.com\/blog\/?p=1091"},"modified":"2017-12-02T10:45:53","modified_gmt":"2017-12-02T03:45:53","slug":"pro-kontra-terkait-3-rancangan-aturan-baru-ojk-untuk-startup-p2p-lending-indonesia","status":"publish","type":"post","link":"http:\/\/sewakantorsurabaya.com\/blog\/pro-kontra-terkait-3-rancangan-aturan-baru-ojk-untuk-startup-p2p-lending-indonesia\/","title":{"rendered":"Pro Kontra Terkait 3 Rancangan Aturan Baru OJK untuk Startup P2P Lending Indonesia"},"content":{"rendered":"<h5>khtisar<\/h5>\n<ul>\n<li>Tiga rancangan aturan baru OJK ini meliputi pembatasan waktu penyimpanan dana di rekening\u00a0<em>escrow<\/em>, penggunaan layanan\u00a0<em>credit scoring\u00a0<\/em>pihak ketiga, dan peraturan Anti Pencucian Uang (APU) dan Pencegahan Pendanaan Terorisme (PPT).<\/li>\n<\/ul>\n<hr \/>\n<p>Pada akhir tahun 2016 yang lalu, Otoritas Jasa Keuangan (OJK) telah <a href=\"https:\/\/id.techinasia.com\/4-aturan-ojk-tentang-bisnis-peer-to-peer-lending-yang-harus-diketahui\">merilis Peraturan OJK (POJK) Nomor 77 Tahun 2016<\/a> yang mengatur legalitas layanan <em>peer to peer (P2P) lending<\/em> di tanah air. Aturan tersebut pun menjadi dasar hukum bagi OJK untuk <a href=\"https:\/\/id.techinasia.com\/ojk-beri-izin-operasional\">memberikan status Terdaftar<\/a> bagi puluhan <em>startup P2P lending<\/em> yang beroperasi di Indonesia.<\/p>\n<p>Namun aturan tersebut sebenarnya masih merupakan penjelasan umum, yang perlu dijabarkan lebih rinci lagi dengan beberapa aturan tambahan. Itulah mengapa OJK saat ini tengah menyusun dua buah Surat Edaran yang nantinya akan mengatur <a href=\"http:\/\/www.ojk.go.id\/id\/regulasi\/otoritas-jasa-keuangan\/rancangan-regulasi\/Pages\/Permintaan-Tanggapan-Masyarakat-atas-RSEOJK-tentang-Penyelenggaraan-Layanan-Pinjam-Meminjam-Uang-Berbasis-TI.aspx\" target=\"_blank\" rel=\"noopener\">proses penyelenggaraan <em>P2P lending<\/em><\/a>, serta <a href=\"http:\/\/www.ojk.go.id\/id\/regulasi\/otoritas-jasa-keuangan\/rancangan-regulasi\/Pages\/Permintaan-Tanggapan-RSEOJK-Pendaftaran-Perizinan-dan-Kelembagaan-Penyelenggara-Layanan-Pinjam-Meminjam-Uang-Berbasis-TI.aspx\" target=\"_blank\" rel=\"noopener\">proses pendaftaran untuk <em>startup P2P lending<\/em><\/a>, dengan lebih jelas.<\/p>\n<p>Pada tanggal 22 November 2017 yang lalu, OJK pun mengundang berbagai pihak untuk memberikan pendapat terhadap rancangan Surat Edaran tersebut. Berikut ini adalah beberapa hal dalam rancangan Surat Edaran tersebut yang menjadi perhatian OJK dan para pemain <em>P2P lending <\/em>Indonesia.<\/p>\n<h3>Waktu penyimpanan dana di Escrow Account akan dibatasi<\/h3>\n<p class=\"paragraph-attachment\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-232169\" src=\"https:\/\/d26bwjyd9l0e3m.cloudfront.net\/wp-content\/uploads\/2017\/11\/Escrow-Account-P2P-Lending-Indonesia.jpg\" alt=\"Escrow Account P2P Lending Indonesia\" width=\"1100\" height=\"620\" data-action=\"zoom\" \/><\/p>\n<p>Apabila kamu ingin menginvestasikan uang di sebuah layanan <em>P2P lending<\/em>, maka kamu harus menyimpan sejumlah dana terlebih dahulu. Menurut Peraturan OJK, <strong>dana tersebut tidak boleh disimpan di rekening biasa, melainkan harus diletakkan di Escrow Account milik salah satu bank<\/strong>.<\/p>\n<p>Hal ini dilakukan agar sang penyelenggara layanan P2P <em>lending<\/em> tidak bisa mengambil dana tersebut tanpa izin, atau menggunakannya untuk tujuan lain.<\/p>\n<p>Selama ini, dana yang diletakkan di Escrow Account itu bisa disimpan dengan jangka waktu yang tidak terbatas, persis seperti uang yang kamu simpan di layanan <em>e-money<\/em> seperti <a href=\"https:\/\/id.techinasia.com\/tag\/go-pay\">GO-PAY<\/a> dan <a href=\"https:\/\/id.techinasia.com\/tag\/doku\">Doku Wallet<\/a>. <strong>Namun dalam rancangan Surat Edaran ini, OJK berniat untuk membatasi jangka waktu penyimpanan dana di Escrow Account menjadi hanya tujuh hari.<\/strong> Lebih dari itu, maka dana tersebut harus dikembalikan kepada pengguna.<\/p>\n<p>Ada dua alasan mengapa OJK membatasi waktu tersebut:<\/p>\n<ul>\n<li>Agar layanan <em>P2P lending<\/em> tidak terkesan mengumpulkan dana masyarakat dan menyerupai bank.<\/li>\n<li>Mencegah penggunaan layanan <em>P2P lending<\/em> sebagai sarana untuk pencucian uang.<\/li>\n<\/ul>\n<p>Aturan ini pun mendapat protes dari para pemain <em>P2P lending<\/em> Indonesia. Menurut mereka, hal ini berpotensi menyulitkan para investor yang sebenarnya sengaja menyimpan dana di Escrow Account tersebut karena tengah menunggu adanya investasi yang tepat untuk mereka.<\/p>\n<p>Namun para pemain <em>P2P lending<\/em> yang hadir di rapat tersebut memahami kekhawatiran OJK, dan memberi masukan untuk memperpanjang batasan waktu tersebut menjadi enam puluh hari.<\/p>\n<h3>Keharusan menggunakan layanan <em>credit scoring<\/em> pihak ketiga<\/h3>\n<p class=\"paragraph-attachment\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-232170\" src=\"https:\/\/d26bwjyd9l0e3m.cloudfront.net\/wp-content\/uploads\/2017\/11\/Credit-Scoring-P2P-Lending-Indonesia.jpg\" alt=\"Credit Scoring P2P Lending Indonesia\" width=\"1100\" height=\"620\" data-action=\"zoom\" \/><\/p>\n<p>Untuk menentukan tingkat kelayakan seorang calon peminjam, penyelenggara <em>P2P lending<\/em> harus menggunakan metode <em>credit scoring<\/em>. Mereka bisa membuat sendiri metode penilaian kredit tersebut, atau memanfaatkan jasa pihak ketiga.<\/p>\n<p><strong>Namun dalam rancangan Surat Edaran terbaru ini, OJK mewajibkan seluruh <em>startup P2P lending<\/em> Indonesia untuk menggunakan layanan <em>credit scoring<\/em> pihak ketiga.<\/strong> Hal ini mereka lakukan demi membuat standar, dan mencegah adanya <em>startup P2P lending<\/em> yang menetapkan <em>credit scoring<\/em> secara sembarangan.<\/p>\n<div class=\"read-also\">\n<div class=\"read-also__image\"><img decoding=\"async\" src=\"https:\/\/d26bwjyd9l0e3m.cloudfront.net\/wp-content\/uploads\/2016\/09\/peer-to-peer-lending-featured-image.jpg\" alt=\"read also\" \/><\/div>\n<\/div>\n<p>Hal ini pun ditentang oleh para <em>startup P2P lending <\/em>Indonesia. Selain tidak terlalu mempercayai hasil <em>credit scoring<\/em> dari pihak ketiga, keharusan ini pun dianggap bisa menyulitkan bagi para <em>startup P2P lending<\/em> baru. Mereka pun menyarankan OJK untuk tetap mengizinkan para <em>startup<\/em> untuk membuat metode <em>credit scoring<\/em> sendiri.<\/p>\n<p>Lebih lanjut terkait hal ini, <strong>OJK menyatakan bahwa mereka akan membuat aturan lebih rinci terkait <em>credit scoring<\/em>, prinsip mengenal pengguna secara digital (E-KYC), dan tanda tangan digital, pada tahun 2018 mendatang<\/strong>.<\/p>\n<h3>Persiapan menyambut penerapan aturan APU dan PPT<\/h3>\n<p class=\"paragraph-attachment\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-232171\" src=\"https:\/\/d26bwjyd9l0e3m.cloudfront.net\/wp-content\/uploads\/2017\/11\/Pencucian-Uang.jpg\" alt=\"Pencucian Uang\" width=\"1100\" height=\"620\" data-action=\"zoom\" \/><\/p>\n<p>Dalam rancangan Surat Edaran terbaru ini, OJK pun mencantumkan keharusan bagi\u00a0<em>startup P2P lending<\/em> untuk menaati peraturan Anti Pencucian Uang (APU) dan Pencegahan Pendanaan Terorisme (PPT).
